This page contains the Terms of Use (“Terms”) under which you (“You”) may use the websites and services of Hotelprofessionals.nl (“Hotelprofessionals”) (each as defined below).


These Terms constitute a binding agreement between You and Hotel Professionals. Each time You use or access any Hotel Professionals site, these Terms are deemed to have been accepted by You. If You do not accept the Terms as stated here, do not use the Hotel Professionals site.


The Hotel Professionals Site contains a variety of functionality and services, including an online service for listing - and searching for - employment opportunities. Hotel Professionals Site allows Users to create individual profiles that may contain personal information (“Profiles”) and to make public those Profiles, or portions thereof.


Hotelprofessionals.nl may revise these Terms at any time by posting a revised version on this web page. You should periodically visit this page to inform YOU of the then current Terms, as they will apply to You.


Users who violate these Terms may have their access to and use of the Hotelprofessionals Site suspended or terminated at Hoteprofessionals.nl's sole discretion.


You must be 16 years of age or older to access or use the Hotel Professionals Site in any way. If You are under the age of 18 or a minor under the terms of applicable law, You must use the Website under the supervision of a parent, legal guardian or other responsible adult.


1. Using the Content of the Hotel Professionals Site.

The functionality to post a job or other functionality of the Hotel Professionals Site may only be used by private individuals seeking employment and/or career information and by employers seeking employees. In the event of any conflict between these Terms and any other contract You have with Hotelprofessionals.nl, the terms of Your contract shall prevail. The term “Places” as used herein means information that You transmit, post or display on the Hotel Professionals Site.


All Hotelprofessionals.nl Users agree to abide by the prohibition to:

(a) material

make available, post, distribute, store or destroy, including without limitation Hotel Professionals Content, in violation of any applicable law or regulation, including, but not limited to, any law or regulation governing the collection, processing or transfer of personal information is recorded - as well as material that violates the privacy policy of Hotelprofessionals.nl;

(h) aggregate, copy or duplicate in any manner the Hotel Professionals Content or information available on any Hotel Professionals Site, including expired job openings, other than as permitted in these Terms;


(i) include or link to the Hotel Professionals Content or information available on the Hotel Professionals Site, except as permitted under these Terms;


(j) post any content or material that propagates or endorses false or misleading information or illegal activities or that provides instructional information about illegal activities or other activities prohibited by these Terms, such as making or purchasing illegal weapons, invasion of anyone's privacy, providing or creating computer viruses or pirated media;


(k) post any resume or apply for any job opportunity on behalf of a third party;


(l) transfer any contact of an employer to any agent, agency or third party;


(m) post more than one copy of the same resume at any time;


(n) sharing with third parties any login codes to any Hotel Professionals Site;


(o) accessing data not intended for You or logging into a server or account for which You are not authorized to access;


(p) posting or transmitting to the Hotel Professionals Site any incomplete, erroneous, or inaccurate biographical information;


(q) post content that is prohibited or post password-only pages or hidden pages or images;


(r) acquire passwords or personally identifiable information from other Users;


(s) remove or alter any material posted by any other person or entity;


(t) cause disruption, disruption or encourage disruption of any group, company or individual:


(u) send any User unsolicited mail or e-mail, make cold calls or send unsolicited faxes to anyone promoting and/or promoting products and services or contacting those Users who have specifically requested not to be contacted by You approached;

(x) use the Hotel Professionals Services for any unlawful purpose or activity or post or transmit any content, resume, or job posting that is defamatory, libelous, implicitly or explicitly offensive, vulgar, obscene, threatening, abusive, to hate speech, is racist, discriminatory or threatening in nature, or may cause irritation, inconvenience cause embarrassment or fear or cause harm to any person or contain a link to pornographic, indecent or sexually explicit material of any kind, as determined by Hotelprofessionals.nl's decision; or


(y) post a resume that is not your average resume and whose purpose is to advertise or promote products or services.


Violation of system or network security may result in civil liability and/or criminal prosecution. Hotelprofessionals.nl will investigate all incidents that may involve such violations and may involve and cooperate with legal authorities in prosecuting Users involved in such violations.


3. Additional Terms Applicable to Employers.

You are responsible for maintaining the confidentiality of Your employer account, Profile and passwords where applicable. You may not share Your password or other access information to Your account, temporarily or permanently, with any other third party, and You are responsible for any use that may be made of Your registration with the Hotelprofessionals Site and passwords, with or without Your consent, is made. You agree to immediately notify Hotelprofessionals.nl of any unauthorized use of Your employer account, Profile or Your passwords.


Employers are solely responsible for their job posting on the Hotel Professionals Site. Hotelprofessionals.nl is not considered an employer with respect to Your use of the Hotelprofessionals Site and Hotelprofessionals.nl is not responsible for any employment decision, for any reason whatsoever, made by any party posting job opportunities on the Hotelprofessionals Site .


You understand and acknowledge that if You cancel Your Employer Account or Your Employer Account is terminated, all of Your Hotelprofessionals.nl account information, including stored resumes, network contacts and email address lists, will be marked as deleted in - and may be removed from, the Hotelprofessionals.nl database. Information may remain available for some time due to delays in carrying out deletion by Hotelprofessionals.nl's internet servers.


Job applicant profiles derived from the User Content may also be made available through the Sites. Hotelprofessionals.nl makes no warranty as to the accuracy or reliability of such derivative works or their suitability for evaluation by employers. Derived profiles may differ significantly from the User Content.


VACANCIES

It is not permitted to include in a posted vacancy:

(a) hyperlinks other than those for which Hotelprofessionals.nl has specifically given permission;


(b) misleading, illegible or “hidden” keywords, repeated keywords or keywords that are not relevant to the vacancy offered, as Hotelprofessionals.nl reasonably determines;


(c) names, logos or trademarks of non-affiliated companies other than those of Your customer and except those for which Hotelprofessionals.nl has given explicit permission. (d) names of higher education, localities, states, cities or countries unrelated to the job posting; (e) more than one job title or job description, more than one location, or more than one job category, unless the product allows it;


(f) careless, incorrect or misleading information; and


(g) material or links to material that sexually, violently or otherwise exploits people or solicits personal information from anyone under the age of 16.


You may not use Your Hotelprofessionals.nl vacancy to:

(a) post job openings in a manner inconsistent with applicable local, national and international laws, including, but not limited to, laws governing labor and employment, equal employment opportunity and eligibility requirements, data protection, access and use of data and intellectual property.


(b) post job openings that require citizenship of a particular country or legal permanent residence in any country as a condition of employment, unless required to comply with law or regulation or to comply with a contract with a national, state or local government;


(c) post job postings that include a requirement or selection criteria for the job posting where such requirement or criteria is not an actual and legal requirement for that job posting;


(d) post job openings or other advertisements for competitors of Hotelprofessionals.nl or post job openings or other content that contains links to any site that competes with Hotelprofessionals.nl.


(e) sell, recommend or advertise any products or services

(f) post any franchise, pyramid scheme, club membership, distribution network, network marketing opportunity (Multi-level) or sales agency arrangements;


(g) posting any business opportunity that requires payment in advance or periodically or that requires the recruitment of new members, sub-sellers or sub-agents;


(h) posting any business opportunity on a commission basis, unless the job posting clearly states that the available job is commission-only and clearly describes the product the job seeker is to sell;


(i) promoting any opportunity that does not represent bona fide employment;


Hotelprofessionals.nl reserves the right to remove any job posting or content from any Hotelprofessionals Site that Hotelprofessionals.nl reasonably determines does not comply with the Terms and Conditions above or if any content has been posted that Hotelprofessionals.nl believes that it does not serve the interests of Hotelprofessionals.nl.


If at any time during the time You use Hotelprofessionals, You tell Hotelprofessionals.nl untruths or otherwise mislead Hotelprofessionals.nl regarding the nature of Your business activities, this is a reason for Hotelprofessionals.nl to terminate use of the Hotel Professionals Services with immediate effect and without any right to compensation, refund or remission of agreed services or products.


4. User Content and Materials Made Available.

You understand that any information, data, text, software, music, sound, photographs, graphics, video, advertisements, messages or other materials made available, posted or displayed by You on or through any Hotel Professionals Site (“User Content”) are the sole responsibility of the person from whom such User Content originated. Hotelprofessionals.nl does not claim ownership or control over any User Content. You or a third party licensor, as applicable, own all patents, trademark rights and copyright in any User Content that you make available, post or display on or through Hotelprofessionals.nl and You are responsible for protecting, appropriately, rights referred to. By making available, posting or displaying User Content on or through Hotelprofessionals.nl, You grant HotelProfess worldwide, non-exclusive and royalty-free permission to copy, modify, distribute and publish such User Content through Hotelprofessionals.nl. In addition, by making available, posting or displaying such User Content that is intended to be available to the public, you grant Hotel Professionals worldwide, non-exclusive and royalty-free permission to copy, modify, distribute and publish such User Content with the aim of advertising Hotelprofessionals.nl and its services.


Hotelprofessionals.nl will terminate this licensed use, within a commercially reasonable period of time, after such User Content has been removed from Hotelprofessionals.nl. Hotelprofessionals.nl reserves the right to refuse to accept, post, display or make available any User Content in its sole discretion.


If You post User Content in any public area of the Hotel Professionals Site, You hereby authorize each User to: access, display, view, store and copy such User Content for personal use. Subject to the foregoing, the originator of such User Content posted on the Hotel Professionals Site retains any and all rights that may exist in such User Content.

Hotelprofessionals.nl does not represent or warrant that the User Content or any other communications posted by Users are truthful, accurate or reliable, nor does Hotelprofessionals.nl endorse any opinion expressed by any User. You acknowledge that any use of material posted by other Users is at Your own risk.

Job applicant profiles derived from the User Content may also be made available through the Sites. Hotelprofessionals.nl has no liability as to the accuracy or reliability of such derivative works or their suitability for evaluation by employers.


Derived profiles may differ significantly from the User Content. We appreciate hearing from our Users and welcome Your comments regarding our services and the Hotel Professionals Site.

Please note, however, that our policy does not permit us to accept or consider creative ideas, suggestions, inventions or materials other than those specifically requested by us.


While we value Your feedback on our services, we ask that You be clear in Your comments regarding our services and not provide any creative ideas, inventions, suggestions or materials. If, despite our request, You send us creative proposals, ideas, drawings, concepts, inventions or other information (collectively, the "Offering"), then this Offering becomes the property of Hotelprofessionals.nl, or, in the event that Hotelprofessionals do not can exclusively acquire all rights with regard to the Offer, you hereby grant Hotelprofessionals.nl an irrevocable and perpetual right of use of all now known or later to be discovered rights to the Offer and the right to make unlimited use of the Offer for any for any purpose, commercial or otherwise, without compensation to You or any other person.

7. Intellectual Property Rights.


Hotelprofessionals.nl respects the intellectual property of others and we ask our Users and content partners to do the same. Posting, reproducing, copying, distributing, modifying, disclosing or performing to the public any copyrighted or trademarked works without permission violates the rights of the owners. As a condition of Your use of the Hotel Professionals Site, You agree not to use the Hotel Professionals Site to infringe in any way the intellectual property rights of others. Hotelprofessionals.nl reserves the right to terminate the account of any User and to block access to the Hotelprofessionals Sites for any User who is a repeated infringer of copyright or other intellectual property rights of others.


Hotelprofessionals.nl reserves the right, in its sole discretion, to take action to terminate access to the site and/or terminate accounts at any time, in its sole discretion, against Users who violate any intellectual property rights of others , regardless of whether this violation is repeated, with or without notice and without any liability to the User who has been terminated or to the User whose access has been blocked. Hotelprofessionals.nl is entitled to assign the agreement between You and Hotelprofessionals (i) to any party in connection with a merger, consolidation, reorganization or sale of all or substantially all of Hotelprofessionals.nl's assets, or (ii) to a party that has control over or falls under the control of Hotelprofessionals.nl or falls under the same control with Hotelprofessionals.nl.
